Privacy Policy

Pomi.org (the “Site”) is a service offered by Combined Jewish Philanthropies of Greater Boston, Inc. (CJP). Your privacy is important to us. This Privacy Policy (the “Policy”) explains our policy regarding the collection, use, disclosure and protection of your information. This Policy applies to information provided or collected through the Sits and in connection with Pomi.org’ various services and products (collectively, “Services”). This Privacy Policy does not apply to our data collection activities offline or otherwise outside of the Site (unless otherwise stated below), and does not govern the data practices of third parties that may interact with the Site. If you have any questions about this Privacy Policy, please feel free to contact us via the contact page on Pomi.org page. Please review the Site’s Terms of Use, which governs your use of the Site.

 

Information We Collect

You may visit our Site without providing any information that identifies you personally (“Personally Identifying Information”). However, if you wish to receive communications from us, such as a weekly digest of content, alerts or mobile alerts, you will need to register for the given Site by providing us with certain Personally Identifying Information. You may also choose to provide us with Personally Identifying Information in any communications you send us. The types of Personally Identifying Information that we may collect about you include: name, age, gender, income level, religious affiliation, marital status, address, corporate alliance, email address, telephone number, fax number and information about your interests in and use of our products. You are not legally required to provide us with Personally Identifying Information, but if you choose not to do so, you may not be able to use certain aspects of the Site or Services. 

We offer you opportunities to engage in public activities through our Site and Services. “Public activities” are any actions you take that are designed to be visible to other users, including comments, recommendations, reviews, ratings or any other items that you submit to a Site. We may also, at our sole discretion, permit you to start a blog, post events or open an organization page on a Site. Any information you disclose in your public activities, along with your screen name or ID, or any image or photo, becomes public and may be used for online and offline promotional or commercial uses in any and all media. If you choose to engage in public activities, you should be aware that any personal information you submit there can be read, collected or used by other users of these areas, and could be used to send you unsolicited messages. We are not responsible for the Personally Identifying Information you choose to submit in these areas and we have no responsibility to publish, take down, remove or edit any of your public activities or any of your submissions that are a result of your public activities. By choosing to participate in public activities, you are electing to share and display such public activities via the Site.

When you share or recommend (with or without adding your own comments) any Site’s content to your social media profile, that action is governed by the social media platform’s Data Policy. We do not track or store a record of those comments or actions.

If you have registered for a Pomi.org account, we may track and aggregate your public activities onPomi.com, as appropriate. If we collect this information, we will use it in connection with our operation of the Site and Services.

We may collect information regarding your activity on the Site, such as your browsing history and amount of time engaged with the content. We also may collect certain non-personally identifying information when you visit many of our web pages, such as the type of browser you are using, the type of operating system you are using and access times.

The Site may look up precise information about your location via your browser, but only with your consent. This information is not stored by us and is used solely for the purpose of location-based searching. We also may collect your IP address or information about the mobile device or other device you use to access the Services, such as geo-location information, unique device identifiers, browser type, browser language or other information. Information that we collect that does not personally identify you is referred to herein as “Non-Personal Information.”

 

How We Use Information

We will not share Personally Identifying Information provided to us with third parties without your explicit permission, except as set forth herein or as we believe in good faith is required by law, regulation, subpoena or court order, or to cooperate with any investigation carried out by a law-enforcement agency.

We and our affiliates will use Personally Identifying Information for the purpose for which you submitted it to us, such as to respond to your inquiry, to send you information about us and about our products and Services, to fulfill a request by you for written materials (such as a weekly digest, email news alert or SMS news alert) or to carry out transactions which you have requested. If you no longer wish to receive a specific digest or alert, you can notify us via the contact page on Pomi.org page.

We may use the information you provide to provide you with customized reading recommendations or targeted advertising on our Site or our mobile applications. We may use information about your device in order to personalize your experience toward the specific device you are using or to send specific advertising. We may use location information to provide you with information-specific content or advertising.

We may use information about your use of the Site or Services, including the history of the pages you view and time spent engaged on individual content pages, to analyze usage of the Site or Services. We may choose to make available mobile applications that can deliver content or advertising based on your current location. We reserve the right to send you emails relating to your account status or specific to your use of the Site and Services. In addition, we may send you emails inviting you to participate in user surveys or asking for feedback, or other information to better understand our customers. We may use third parties to provide us information, reports and analysis about the usage and browsing patterns of users of the Site or Services. We use tools such as Google Analytics  to collect information about use of the Site. They collect information, such as how often users visit the Site, what pages they visit when they do so, how much time users are spending on reading content based on the pages that are open, the scrolling and mouse movement on that page, and what other site they used prior to coming to the Site. We use the information we obtain from these tools only to improve this Site. Google Analytics collects only the IP address assigned to you on the date you visit the Site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with Personally Identifying Information. Although Google Analytics and the other tools we utilize plant a permanent cookie on your web browser to identify you as a unique user, the next time you visit the given Site the cookie cannot be used by anyone but the company providing that tool. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Service and Privacy Policy

By analyzing the information we collect, including all Non-Personal Information, we may compile certain statistical information, such as anonymous information about how you use the Site and Services and which content you view (“Statistical Information”). Statistical Information helps understand trends and customer needs so that new products and Services can be considered and so existing products and Services can be tailored to customer desires, and may include demographic and marketing analyses of our users, as well as their subscribing and purchasing patterns. Statistical Information is anonymous and will not be linked to any Personally Identifying Information for provision to third parties. We may share such Statistical Information with third parties, without restriction, on commercial terms that we can determine at our sole discretion, without any obligation to you. Nothing in this Privacy Policy is intended to restrict our use of Statistical Information or other de-identified information in any way. To the extent we associate Statistical Information with your Personally Identifying Information we collect directly from you on the Site, we will treat it as Personally Identifying Information.

In addition, we may provide you with the opportunity (on an opt-in basis) to receive promotional emails, which include content provided by our partners or advertisers that we think may be of interest to you. Such partners and advertisers will not be able to access any of your Personally Identifying Information. We will not send unsolicited messages to you if you indicate that you do not wish to receive such messages. In addition, you may remove yourself from any or all of the electronic newsletters’ mailing lists at any time by following instructions for unsubscribing found at the end of every email.

 

Other Uses of Your Information

We may disclose Personally Identifying Information in response to legal process, for example, in response to a court order or a subpoena. In addition, we will fully cooperate with any law-enforcement authorities or court order requesting or directing us to disclose the identity, behavior or digital content of any user suspected to have engaged in illegal, infringing or offensive behavior on the Site.

We may exchange information with third parties (including, but not limited to, merchants) for the purposes of fraud protection.

We may transfer our databases containing your personal information if we sell our business or part of it, or merge or partner with other companies and businesses.

We or our affiliates may hire other companies to provide Services on our behalf. These companies will have access to only the personal information they need in order to provide such Services, and will be obligated to maintain the confidentiality of the information and will be prohibited from using it for other purposes. Personally Identifying Information may be stored and processed in the United States or in any other country in which CJP or its affiliates or service providers maintain facilities. Some countries may not have adequate data protection laws or may offer differing levels of protection of personal information that are not as high as in your country of residence or business. By using our Site, you consent to such transfer of information outside your country.

 

Cookies and Other Tracking Technologies

We may use various methods and technologies to store or collect information about your use of the Site, including, without limitation, cookies. A cookie is a small piece of text that is sent to a visitor’s browser by a website. The browser provides this piece of text to the originating web server when this visitor returns. Pomi.org uses cookies to help personalize your experience. In addition, Pomi.org and certain advertisers may use cookies to identify and track visitors, including the browsing history of a user and the website access preferences of users. Cookies help us understand where our visitors are going and how much time they spend there, and allow us to target our advertising on the Site.

Some of our advertisers may use cookies and web beacons when they advertise on our Site. Such cookies and web beacons will also send these advertisers information, including your IP address, your ISP and the browser you used to visit our Site. We do not have access to, nor control over, advertisers’ or service providers’ use of cookies or other tracking technologies or how they may be used.

Most web browsers are initially configured to accept cookies, but you can change this setting so your browser either refuses all cookies or informs you when a cookie is being sent. Also, you are free to delete any existing cookies at any time. Please note that some features of Pomi.org may not function properly when cookies are disabled or removed.

We obtain your consent to our information storage or collection tracking technologies by providing you with transparent information in our Privacy Policy and providing you with the opportunity to make a choice to disable cookies as set forth above. Please note that we are not required to obtain your consent to the information collection tracking technologies identified above that are strictly necessary. We are giving you detailed notice of the tracking technologies and your limited choices regarding them so that your consent is meaningfully informed.

 

Our Commitment to Security

We have put in place physical and electronic procedures to safeguard and help prevent unauthorized access, maintain data security and correctly use the information we collect online. However, no method of transmission over the internet, or method of electronic storage, is 100 percent secure. Therefore, while we strive to use commercially acceptable means to protect your Personally Identifying Information, we cannot guarantee its absolute security.

Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that Personally Identifying Information that we collect will never be disclosed in a manner that is inconsistent with this Policy. Regardless of the precautions taken by you or by us, “perfect security” does not exist on the internet. We cannot ensure or warrant the security of any information you transmit to us, and you transmit such information at your own risk.

You can access other websites of third parties through our Site. Any personal information you provide on the linked pages is provided directly to the third-party website and is subject to that third party’s privacy policy. Except as described above, we and our affiliates are not responsible for the content or privacy practices of websites to which we link. Links from our Site to third-party site are provided for your convenience. We encourage you to learn about the privacy practices of each website before providing them with any personal information.

 

Children

CJP and JCCGB will collect data of minors provided by minors’ parent or guardian such as, but not limited to name, date of birth, prior involvement and areas of interest. Data may be shared with CJP, JCCGB, and communal partner agencies as deemed necessary to provide high quality engagement activities and community connection points. We will not require disclosure of more information than is reasonably necessary to participate in an activity or event.  You can review their child’s personal information, direct us to delete it, and refuse to allow any further collection or use of the child’s information at any time via the contact page on Pomi.org.

Terms of Use

Pomi.org  (the “Site”), is the digital home for families with young children in our Jewish community in Boston, and is owned and operated by Combined Jewish Philanthropies of Greater Boston, Inc. (CJP). You do not need to be a registered user to search or view events and content (as defined below) onPomi.org; however, you must be a registered user of the website to post content, including events and blogs.

By accessing or using the pages within the Site, you agree to the Terms of Use presented here. If you do not agree, you should not use the Site. These Terms of Use may be changed or updated from time to time, so check back regularly. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use. When you use Pomi.org you are also subject to our  Privacy Policy, which are incorporated into the Terms of Use presented here.

You agree to use the Site only for lawful purposes. You agree not to take any action that might compromise the security of the Site, to render the Site inaccessible to others, or to otherwise cause damage to or interfere with others’ use of the Site or their content. You agree not to use the Site in any manner that might interfere with the rights of third parties. You will not bully, intimidate or harass any user. You will not post content that is hateful, threatening, pornographic or that contains nudity or graphic or gratuitous violence. You will not use the Site to do anything unlawful, misleading, malicious or discriminatory. You will not use the Site to transmit or send unsolicited commercial communications. Prior written consent must be obtained to make commercial offers of any kind, whether by advertising, solicitations, links or any other method of communication. Without limiting any former restrictions, you may not link to other websites for the purpose of selling merchandise or services of any kind.

The Site contains advertisements, offers or other links to other websites and resources of third parties that we do not control. That information, as well as advertisements, may or may not be or remain wholly accurate. You acknowledge and agree that CJP is not responsible or liable for (i) the availability or accuracy of such sites or resources; or (ii) the content, advertising or products or services on or available from such sites or resources. The inclusion of any link on the Site does not imply that we endorse the linked website. You use the links at your own risk. Our Privacy Policy is applicable only when you are on the Site.

Any violators of these Terms of Use will be investigated and pursued through legal action, which includes removing the offending user content from the Site and excluding such offending user from use of the Site. If you believe you have been wrongly accused of such a violation, you should contact CJP. CJP may remove any content that you upload or post at the Site or disable your access to the Site at any time, for any or no reason, and without notice to you.

 

Registered Members

If you register as a member of the Site, you agree to provide accurate and complete information about you as may be prompted by any registration forms on the Site. To the extent such information about you changes, you agree to promptly update such registration information with the Site to keep it accurate, current and complete. You shall not register for more than one user account or impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity.

You are responsible for maintaining the confidentiality of your member password and login, and are fully responsible for all activities that occur under your password or account with or without your knowledge. If you knowingly provide your login and password information to another person, your membership privileges may be suspended temporarily or terminated. You agree to immediately notify CJP of any unauthorized use of your membership password or login.

The Site may include an interface through which you can post messages and respond to the messages of others. CJP does not assert any ownership over the information and content posted or uploaded by its members onto the Site’s content and, except for the below license, you retain all rights that you may have in the content you post or upload. By posting content to the Site you grant, and you represent and warrant that you have a right to grant, to CJP and our affiliates, subject to the terms of the Privacy Policy and for any purpose, a non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, display, perform, distribute, translate, edit and create derivative works based upon your content.

You may not post, transmit or share content that you did not create on the Site unless you own rights in such content or have permission to post such content from the owner of such content. You understand and agree that CJP may, but is not obligated to, review the Site and may delete or remove (without notice) any content in its sole discretion, for any reason or no reason, including content that in the sole judgment of CJP violates these Terms of Use, or which might be offensive, illegal or that might violate the rights, harm or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any content you post or store on the Site or provide to CJP. You agree not to disclose to any person or entity personally identifiable information about other members that you learn while using the Site without the express consent of such members.

 

Registration Termination

You agree that CJP may, with or without cause, immediately terminate your Pomi registration and access to the Site (including to user content you may have posted) without prior notice. Without limiting the foregoing, the following may lead to a termination by CJP of a member’s registration and use of the Site:

  • breaches or violations of these Terms of Use or other Pomi agreements or guidelines
  • requests by law enforcement or other government agencies
  • a request by you (self-initiated membership cancellation)
  • unexpected technical issues or problems
  • extended periods of inactivity

CJP has no obligation to maintain, store or transfer to you information or data that you have posted on or uploaded to the Site.

 

Children

Proprietary Rights in Site

Unless otherwise stated, CJP and/or its licensors own the intellectual property rights in the Site and material on the Site. Subject to the license below, all these intellectual property rights are reserved.

Subject to these Terms of Use and your continued compliance therewith, you are hereby granted a personal, revocable, royalty-free, nonexclusive, nontransferable license to use the Site and the text, graphics, data, information and other content made available through the Site (collectively, “content”). No content at the Site may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted or sold in any form or by any means, in whole or in part, without CJP’s prior written permission, except that the foregoing does not apply to your own content that you legally post on the Site. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights. The content may be accessed, printed, displayed, downloaded and distributed for personal, educational or news reporting purposes, provided that all copies display all copyright and other applicable notices to the extent and in the form such notices are displayed in connection with such content and provided further that you do not use the content in any manner that implies, suggests or could otherwise be perceived as attributing a particular policy, opinion or objective to CJP. You must also provide proper attribution in connection with your use of any content. Proper attribution shall at a minimum state that the content is “used with the permission of Combined Jewish Philanthropies of Greater Boston.” Any rights not expressly granted herein are reserved.

You must not:

  • sell, rent or sub-license material from the Site;
  • reproduce, duplicate, copy or otherwise exploit material on the Site for a commercial purpose; or
  • edit or otherwise modify any material on the Site.

Service-Level Agreement

Pomi.org makes every effort to be up and running seven days a week, 24 hours a day. We will notify users well in advance if the Site need to be taken offline for routine maintenance. In the event of an unexpected disruption, we will notify users as soon as possible and correct the situation promptly. Please note that we are not a shomer Shabbat organization.

 

Fees

Pomi reserves the right to from time to time change these Terms of Use and charge for registration and/or to provide additional optional services for a fee. 

 

Disclaimer of Warranties

The Site and the content and services made available on the Site are provided on an “as is” and “as available” basis. Pomi does not make and disclaims all express and implied warranties and representations, including, but not limited to, any implied warranty of fitness for a particular purpose, with regard to the Site, the content at the Site or any advice or services provided through the Site to the extent permitted by law. Pomi does not warrant that access to the Site, your or other members’ content, other content at the Site or services will be uninterrupted or error-free, that defects in the site will be corrected or that the Site are free from viruses or other harmful components.

The advice, recommendations, information and conclusions posted or emailed by other members of the Site are not in any way vetted, approved or endorsed by Pomi, and you use such information at your own risk. You expressly agree that use of the Site, including all content, data or software distributed by, downloaded or accessed from or through the Site, is at your sole risk.

 

Limitation of Liability

Under no circumstances shall CJP, its partners, contributors, agents, employees, directors or affiliates be liable for any indirect, incidental, special, exemplary, punitive or consequential damages (even if it has been advised of the possibility of such damages), including but not limited to such damages for lost data, due to your use of this Site or due to your reliance on any of the content contained or the services provided on or through the Site.

 

Indemnification

You agree to indemnify and hold harmless CJP, its officers, employees, agents, subsidiaries, affiliates and other partners, from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from your use of the Site or your violation of these Terms of Use.

 

Digital Millennium Copyright Act

Notification: If you are a copyright owner or an agent thereof and believe that any user content infringes upon your copyright, you may submit a written notification pursuant to the Digital Millennium Copyright Act (“DMCA”) (see 17 U.S.C. 512(c)(3) for further information) by providing our Copyright Agent (listed below) with the following information:

  • an electronic or physical signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  • a description of the copyrighted work claimed to have been infringed or if multiple copyrighted works are covered by a notification, a representative list of such works at our Site
  • a description of the location on the Site of the allegedly infringing material(s); your address, telephone number and email address
  • a written statement that you have a good faith belief that use of the material(s) in the manner complained of is not authorized by the copyright owner, its agent or the law
  • a written statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Only notices of alleged copyright infringement should go to the Copyright Agent; any other feedback, comments, requests for technical support and other communications should be directed to Pomi’s customer service through contact page on Pomi.org. You acknowledge that if you fail to comply with all of the notice requirements of the DMCA, your notice may not be valid.

Counter Notification: If you believe that any user content of yours that was removed is not infringing, or that you have the appropriate rights from the copyright owner or third party, or pursuant to the law, to post and use the material in your user content, you may send a counter notification containing the following information to the Copyright Agent:

  • your physical or electronic signature
  • identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  • a statement (under penalty of perjury) that you have a good faith belief that the content was removed or disabled as a result of a mistake or a misidentification of the material
  • your name, address, telephone number and email address, along with a statement that you consent to the jurisdiction of the federal court in Boston,  MA and a statement that you will accept service of process from the person who provided notification of the alleged infringement

If a counter notification is received by the Copyright Agent, CJP may send a copy of such counter notification to the original notifying party. The original notifying party shall have ten (10) business days to file an action for copyright infringement and seek a court order against the content provider or user posting such material. If no such infringement action is filed within such 10 business days, we may, in our sole discretion, reinstate the removed material or cease disabling such material.

In accordance with the DMCA and other applicable law, CJP may, in appropriate circumstances, terminate access, at CJP’s sole discretion, of any user that we find to be a repeat infringer of others’ copyrights. CJP may also, in its sole discretion, limit or fully terminate access to the Site of any user infringing the intellectual property rights of others, regardless of whether such user is a repeat offender or not.

 

Miscellaneous Terms

These Terms of Use and all performances and claims of every nature (including without limitation, contract, tort and strict liability) relating in any way to any aspect of the Site are governed by the laws of the Commonwealth of Massachusetts without regard to any conflicts of laws or principles that would result in the application of the law of a different jurisdiction. Any disputes regarding such claims or arising under or related in any way to these Terms of Use or the Site shall be heard exclusively in the appropriate forum in Massachusetts. You and CJP agree to submit to the personal and exclusive jurisdiction of the courts located within Suffolk County, Massachusetts. You hereby waive any claim or defense that such forum is not convenient or proper, and consent to service of process by any means authorized by Massachusetts or federal law.
